NOTICE TO ALL USERS:

CAREFULLY READ THE FOLLOWING LEGAL AGREEMENT REGARDING THE USAGE/LICENSE OF POWERMATH, BY POWERCLASSROOM SOFTWARE, LLC. BY SIMPLY USING THIS SOFTWARE, YOU (INDIVIDUAL OR ENTITY) CONSENT TO BE BOUND BY AND BECOME A PARTY OF THIS AGREEMENT.

Grant: Subject to the full monthly payment of applicable licensing fees, and subject to the terms and conditions of this agreement, POWERCLASSROOM SOFTWARE hereby grants you a non-exclusive, non-transferable right to use one copy of the specified version of the software. You may access one copy of the software on one computer. If the software is licensed as a library-suite, then the license applies to all software modules.

Usage: The Software is licensed as a single product. The software is “in use” on a device when it is loaded into the temporary memory (RAM) of such device. Single-License means "ONE" single-login-at-the-time. Multiple-Licenses means "MANY" logins-at-the-time, dependent on the number of licenses purchased.

Single-License users should beware that by sharing their "User-ID & Password" with anyone means that you will not be able to login back in the system until the time the other user logs-out of the system and releases your "User-ID & Password" once again.
Term: This agreement is effective for an unlimited duration unless and until earlier termination as set forth herein. This agreement will terminate automatically if you fail to comply with any of the limitations or other requirements described herein. Upon any termination or expiration of this agreement, you must destroy all copies of the software and related documentation.
Updates: As a paying subscriber, you are entitled to upgrades of the software when and as POWERCLASSROOM SOFTWARE publishes them.
Ownership: This software is protected by U.S. copyright laws and any provision of international treaties. POWERCLASSROOM SOFTWARE owns and retains all rights, title and interest of the software, including all copyrights, patents, trade secret rights, trademarks and other intellectual property rights therein. Your utilization of the software does not transfer any entitlement of its intellectual property rights, and you will not acquire any rights to the software except as expressly set forth in this agreement.
Restrictions: You may not sell, lease, license, rent, loan or otherwise transfer this software to any third party. You may not reverse engineer, decompile, or disassemble the software. You may not modify or create derivatives based upon this software in whole or in part. You may not copy the software or its documentation.
Warranty & Disclaimer:

Limited Warranty: POWERCLASSROOM SOFTWARE warrants the availability and delivery of the online lessons via the Internet to be free from defective performance all the time (24/7). Likewise, customers are responsible for the performance of their own devices (computers, operating-systems, web browsers, modems, network cards, ISPs, etc.). For best viewing, we recommend the use of broadband rather than dial-up connections.

Disclaimer: Except for the limited warranty set forth herein, the software is provided “as is.” To the maximum extent permitted by applicable laws, POWERCLASSROOM SOFTWARE disclaims all warranties, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement with respect to the software and the accompanying documentation. You assume responsibility for selecting the software to achieve your intended results, and for the usage of, and results obtained from the software. Without limiting the foregoing provisions, POWERCLASSROOM SOFTWARE makes no warranty that the software will be error-free or free from interruptions or other failures or that the software will meet your requirements.
Liability: Under no circumstances and under any legal clause, whether in contract or otherwise, shall POWERCLASSROOM SOFTWARE be liable to you or to any other person for any indirect, consequential or purely financial damages of any character including, without limitation, damages for loss of work stoppage, computer failure or malfunction, or for any and all other damages or losses. In no event will POWERCLASSROOM SOFTWARE be liable for any damages in excess of the listed monthly price POWERCLASSROOM SOFTWARE charges for its software, even if POWERCLASSROOM SOFTWARE have been advised of the possibility of such damages.
Miscellaneous: If for any other reason, any provision of this agreement is held invalid, the remainder of the agreement shall continue in full force and effect. The parties confirm that they fully understand the contents of this agreement written in the English language.
